Markey depicts the bill as necessary to neutralize the court's politicization by Republicans who refused to even consider the nomination of Merrick Garland, then a D.C. Circuit judge and now the US attorney general, in an election year, only to discard that rationale by rushing the confirmation of Justice Amy Coney Barrett late last year to secure the high court's current 6-3 conservative orientation.

In a statement, the NY congressman said the bill would "restore balance to the nation's highest court after four years of norm-breaking actions by Republicans led to its current composition". At issue is the composition of the Supreme Court, where conservatives now have a 6-3 majority. "We're unpacking it. Senator McConnell and the Republicans packed the court over the last couple of years".

Markey was far from the only Democrat making the case that the Supreme Court needed nine justices in 2016. "We're not packing it".

House Speaker Nancy Pelosi said Thursday she has "no plans" to bring the bill to the House floor.

It's not clear that Democrats would be able to do this as there are bound to be numerous defections in the Senate, maybe even in the House. but the fact that Democrats are seriously considering it is shocking enough.

"Speaker Pelosi is a very good judge of events and of and of history", Nadler said, adding that once the current court hands down more "destructive" decisions, "Speaker Pelosi and others will come along". Meanwhile, Republicans are against "packing the court" and have warned the move would be a direct assault on the nation's independent judiciary.

"Time and time again, prominent Democrats show they're no longer content to work within the ground rules and norms of our institutions, but prefer to threaten the institutions themselves", Senate Minority Leader Mitch McConnell said in a statement on Thursday.

Nadler argued that 13 is a "proper number" of justices because it matches the number of federal appellate circuits. All three groups advocate for adding justices.

"Our task now is to build a grassroots movement that puts pressure on every Democrat in Congress to support this legislation because it is the only way to restore balance to the Court and protect our democracy", Fallon said.
