Following Elliot's arrest, the NYPD tweeted, "Thanks to assistance from the public and excellent investigative work by @NYPDHateCrimes Detectives, the individual wanted for Monday's assault of a 65-year-old Asian female, at 360 West 43rd St, was arrested and charged with Felony Assault as a Hate Crime".
The New York Times reports that the victim in the case is 65-year-old Vilma Kari, a native of the Philippines.
"Mr. Elliot is accused of brutally shoving, kicking, and stomping a 65-year-old mother to the ground after telling her that she didn't belong here", Manhattan DA Cyrus Vance Jr. said in a statement.
She was discharged from the hospital on Tuesday after being treated for serious injuries, a hospital spokesperson said.
Residents identified the suspect seen on a video as a local homeless man, according to WABC. "The Asian community has been living with for the last 13 months".
He said it was "absolutely unacceptable" that witnesses did not intervene.
The attack happened late Monday morning outside a luxury apartment building two blocks from Times Square.
The property developer and manager of the building, Brodsky Organization, wrote on Instagram that it was aware of the assault and said staff members who witnessed it were suspended pending an investigation.
In captured surveillance video, he is seen kicking the woman to the ground and stomping on her several times.
"The HPD sent a representative to my place to apologize to me and they told me they were investigating the incident and that the inspector has been suspended", he added. Their union said they called for help immediately.
