Dominion was a target of misleading, false and weird claims spread by President Donald Trump and his allies in the aftermath of Trump's election loss to Joe Biden.

His supporters stormed the U.S. Capitol on January 6 as Congress moved to certify the election results, leaving five dead.

Fox hosts and guests gave life to a false claim that Dominion committed election fraud to help elect President Joe Biden, "taking a small flame and turning it into a raging fire", Dominion lawyer Stephen Shackelford told reporters. Dominion has also sued Donald Trump's personal attorney Rudy Giuliani, pro-Trump lawyer Sidney Powell, and MyPillow CEO Mike Lindell for allegedly touting lies about election fraud.

Earlier this week, Powell tried to fend off the more than $1.3 billion in liabilities against her personally by arguing in a motion to dismiss that "no reasonable person" would believe that her well-publicized comments about an global plot against former President Donald Trump were "statements of fact".

"Fox News Media is proud of our 2020 election coverage, which stands in the highest tradition of American journalism, and will vigorously defend against this baseless lawsuit in court", Fox News said in a statement. Smartmatic filed a $2.7-billion suit against the cable news outlet on February 4.

In its first suit filed against a media company, Dominion claims Fox News pushed the "outlandish, defamatory, and far-fetched" claims as part of an effort to "lure viewers back" after they fled to other networks because they saw Fox as "insufficiently supportive" of President Trump after his loss.

"Fox endorsed, repeated, and broadcast a series of verifiably false yet devastating lies about Dominion", the suit stated. Other right-wing outlets like Newsmax and One America News Network (OAN), both of whom have also gotten legal notices from the voting tech companies, have put out statements distancing themselves from the conspiracy theories they aired and taken down articles which referenced them.

The Dominion and Smartmatic lawsuits represent the biggest legal threat to Fox News to date.

"We obviously hope that filing this lawsuit and proving our case can help with that, but it is an enormous uphill battle, and we're not going to be able to get all the way there, and we know that, and that's why Fox is on the hook for the massive economic damages they've done to Dominion", he added.

In apparent response to the growing number of defamation cases, conservative USA news outlets have begun to rely on prepared disclaimers or additional prerecorded programming to repudiate pro-Trump conspiracy theories spouted by guests and hosts. "We apologize to Dominion for all of the harm this caused them and their employees".

"As Fox well knew, Powell and Giuliani were facially unreliable sources and their claims were ludicrous, inherently improbable, and technologically impossible", the complaint said.

The suit was filed in DE, where both companies are incorporated, though Fox News is headquartered in NY and Dominion is based in Denver.
