In the Supreme Court's decision, justices ruled in favor of the Trump administration, lifting the last remaining injunction protecting IL residents from the rule, which critics have branded a "wealth test" for immigrants.
After the U.S. Supreme Court gave the green light for the regulation, the Trump administration has now begun applying what is known as the "Public Charge" rule - a rule whereby legal immigrants are less likely to secure a permanent residency in the U.S. if they have used any forms of welfare in the past, including any cash benefits for income maintenance, Supplemental Security Income (SSI), Temporary Assistance to Needy Families, Supplemental Nutrition Assistance Program (SNAP)- otherwise known as food stamps, Medicaid, and certain taxpayer-funded housing programs.
Quoting a line from Fox News personality Laura Ingraham's Monday night show, Trump fired back at Justice Sotomayor for "trying to "shame" other justices into voting with her and against Trump.
"Claiming one emergency after another, the Government has recently sought stays in an unprecedented number of cases, demanding immediate attention and consuming limited Court resources in each", Sotomayor wrote in the dissent.
Sotomayor's remarks were made as the Supreme Court is considering such high-profile issues this term as abortion, LGBTQ rights, the Second Amendment, immigration and the president's attempts to shield his financial records.
Sotomayor wrote of the frequency with which the conservative-controlled Court grants the Trump administration stay applications-allowing Trump policies to go into effect even after they've been blocked in the lower courts. "And with each and every successive software, after all, its cries of urgency ring an increasing number of hole. Having first sought a stay in the NY cases based, in large part, on the purported harm created by a nationwide injunction, it now disclaims that rationale and insists that the harm is its temporary inability to enforce its goals in one State".
Sotomayor noted that the government's prior request to lift the nationwide injunction had claimed a need for urgent action because the injunction was nationwide in scope.
"I fear that this disparity in treatment erodes the fair and balanced decision-making process that this Court must strive to protect", Sotomayor added.
The case dealt with the Trump administration's expansion of situations where the government can deny visas to non-citizens looking to enter the U.S.
When the Supreme Court acts on an application to stay an injunction, it must "consider important statutory and constitutional questions that have not been ventilated fully in the lower courts, on abbreviated timetables and without oral argument", she wrote.
"Claiming one emergency after every other, the Govt has just lately sought remains in an unparalleled choice of circumstances, hard rapid consideration and eating restricted Courtroom sources in each and every", she wrote.
