In a defiant letter to the City Law Department, attorneys for Jussie Smollett said the "Empire" actor would not pay the $130,000 tab for the Chicago police investigation of his alleged hate hoax crime attack, and said they intend to demand testimony from Mayor Rahm Emanuel and Supt.

Also, the City of Chicago corporate counsel Ed Siskel sent Smollett a letter a week ago demanding the "Empire" actor to pay up the overtime costs within seven days.

A Chicago attorney and a former judge have both filed a petition to start an investigation into whether Cook County State's Attorney Kim Foxx interfered in the Jussie Smollett investigation.

"Your letter constitutes part of a course of conduct meant to harass and irreparably injure Mr. Smollett", attorney Mark Geragos wrote in response to the City of Chicago Department of Law's request, adding that regardless of their potential lawsuit "Mr. Smollett will not be intimated into paying the demanded sum". "Mr. Smollett vehemently denies making any false statements". "Your claim that Mr. Smollett filed a false police report and orchestrated his own attack is false and defamatory".

"The investigation revealed that Mr. Smollett's statements to police - that on January 29, 2019, two men attacked him while yelling racial and homophobic slurs - were, in fact, true", Geragos wrote.

Police maintain Smollett was guilty of faking the attach and filing a false police report and many are upset the State's Attorney's Office dropped the charges because of the stated belief that Smollett's case wasn't serious enough to warrant jail time.

"In light of their apparent vested interest in this case, we are confident that Mayor Emanuel and Superintendent Johnson will not object to providing their testimony under oath", Gergagos wrote. The surprise decision angered Emanuel, who called it a "whitewash" and said the city's reputation "was dragged through the mud" by Smollett. "Mr. Smollett's preference remains, however, that this matter be closed and that he be allowed to move on with his life". "Our research discloses no cases in which the municipal ordinance to try to get a second bite at the apple once charges against a criminal defendant have been dismissed".

Smollett, who is black and gay, touched off a social media fire storm by telling police on January 29 that two apparent supporters of U.S. President Donald Trump struck him, put a noose around his neck and poured bleach over him. It added that he "will not be intimidated" by the city's demands. They also want to depose not only Johnson and Emanuel, but Smollett's alleged collaborators Abimbola Osundairo and Olabinjo Osundairo. "The state's attorney's office has to provide more information about the rationale for the decision to drop the charges".
