Lance Armstrong to pay US$5m settlement in US fraud case: lawyer

Lance Armstrong to pay US$5m settlement in US fraud case: lawyer Lance Armstrong to pay US$5m settlement in US fraud case: lawyer
Bennie Garza | 20 April, 2018, 04:17

Discredited cyclist Lance Armstrong has agreed a $5million settlement to a False Claims Act brought against him by former team-mate Floyd Landis and the United States Postal Service (USPS). Besides this $5 million settlement, Armstrong will cover £1.65 million to cover Landis's economical costs, Peters said. The seven-time Tour de France victor (those victories were officially stripped by the U.S. Anti-Doping Agency in 2012) avoided having to pay the massive sum for the lawsuit that began way back in 2010.

Armstrong's legal team were always adamant that the US Postal Service actually made money out of their sponsorship of the team.

"The Postal Service and Landis had sought $100 million (€81m) in damages from Lance, but in light of several significant court rulings rejecting and limiting the plaintiffs' damages theories, the case today settled for $5 million (€4m), plus an additional amount to pay attorneys' fees to Landis's lawyer", Peters said in the statement.

Nevertheless, according to the agreement, the settlement "is neither an admission of liability by Armstrong nor a concession by the United States or Relator [Landis] that their respective claims are not well founded".

Seeking millions it spent sponsoring Armstrong's powerhouse teams, the government joined the lawsuit against Armstrong in 2013 after his televised confession to Oprah Winfrey to using steroids and other performance-enhancing drugs and methods.

He has a weekly podcast, "The Forward", in which he interviews authors, movie stars and sports figures, and "Stages", Armstrong's audio and video analysis of last year's tour, was an iTunes hit.

"I am glad to resolve this case and move forward with my life", Armstrong said. Armstrong got almost $13.5 million.

Armstrong later confessed to using performance-enhancing drugs and was banned from all competitions for life and stripped of his seven Tour titles. "There is a lot to look forward to". The government countered that Armstrong had been "unjustly enriched" through the sponsorship and that the negative fallout from the doping scandal tainted the agency's reputation. In 2012, after the United States Anti-Doping Agency accused him and his teammates of doping, he was stripped of his Tour de France titles.

As the originator of the whistleblower lawsuit, Landis stands to be awarded up to a quarter of the settlement. Since 2013, the government has been involved, but Armstrong's legal team has been trying to get the case thrown out just as long. He was set to appear at a major one-day cycling race in Belgium three weeks ago, before pulling out citing a family emergency. Peters added that the Postal Service had previously boasted that sponsoring Armstrong's cycling team for $32 million was a marketing boon. The Livestrong Foundation, which supports people with cancer, also cut ties with Armstrong: It was established in 1997 as the Lance Armstrong Foundation.

"But he does have to pull together some funds to pay the government over the next year", Peters said.

Although rumours of drug use swirled around Armstrong throughout his career, he never failed a test.
