Smollett, who is black and openly gay, had told police he was attacked as he was walking home around 2 a.m. on January 29.

The counts in the indictment obtained by CNN say Smollett gave statements to a Chicago police officer after the incident and to a detective. Days before the January 29 incident, a letter threatening Smollett was sent to the studio where the television show is filmed - a letter Chicago Police Supt.

Smollett, 36, who is black and openly gay and plays a gay musician on the Fox network hip-hop drama "Empire", was charged last month in a single-count criminal complaint with making a false report to police, defined under IL law as a form of disorderly conduct.

Schmidt, the attorney for the brothers, said her law firm did its own investigation.

One of Smollett's attorneys, Tina Glandian, said she didn't have any objections to media access because "much of the leaked information is actually demonstrably false".

"This was someone who the brothers thought could help their career. someone they had trusted to consider their best interest", she continued.

"I haven't' seen one piece of evidence and they don't have one piece of evidence that they've turned over that links Jussie to this", Geragos said, referring to allegations that the attack was orchestrated.

"They were paid for the training. but they were also asked to do this favor for him", she told the anchor.

Television actor Jussie Smollett, arrested last month on a single charge of perpetrating a hate-crime hoax, has been newly indicted on 16 felony counts of falsely reporting to police that he was assaulted by two strangers shouting racist and homophobic slurs.

As previously reported, the check Smollett signed for the brothers was not for the attack, but, instead, for a training and nutrition program. Abel and Ola's attorney, Gloria Schmidt, also told TMZ the $3,500 check was compensation for a training and nutrition program created to get Jussie in shape for a music video shoot.

"They feel tremendously regretful for their role in this, and their involvement in the situation", Schmidt said. "These are details that came out with my clients fully cooperating with the police", she said.

I think they will keep the movement going, because this is really the worst case scenario.

An attorney for Ola and Abel Osundairo said they feel "betrayed" by the actor and are trying "to pick up the pieces of what this has done to their lives".
