Gutierrez previously said in September that the law upon which Judd's claim was based "has never before been applied to an employer's sexual harassment of a prospective employee, and the court is not convinced that the statute was meant to cover such harassment".

She claimed he further blacklisted her from other movie roles, too, and eventually sued him under the legal theory of "sexual harassment in a professional relationship".

Judge Philip Gutierrez, sitting in the United States District Court in Los Angeles, ruled that the actress' claim does not fall within the scope of a California statute. But the judge ruled that lawmakers had "modified, rather than clarified" the 1999 law, making it inappropriate to apply its new standards retroactively.

"Weinstein appeared in a bathrobe, and, instead of discussing film roles, asked if he could give her a massage".

Judd attorney Theodore Boutrous Jr. says nothing about the ruling changes the fact that Judd's lawsuit is moving forward, and her strong case remains intact.

ET confirms that Ashley Judd's sexual harassment claim against the 66-year-old producer has been released.

Judge Gutierrez said that he was not determining whether Ashley had been sexually harassed by the studio executive "in the colloquial sense of the term", and she was still free to go ahead with her defamation case against him.

In her lawsuit, filed last April, Ms Judd accused Mr Weinstein of smearing her reputation by discouraging director Peter Jackson from casting her in his movie franchise The Lord of the Rings. Weinstein has denied those allegations.

Weinstein's lawyers in July insisted Judd had struck a "deal" with Weinstein allowing him to touch her if she "won an Academy Award in one of his films".

Weinstein's attorney in this case, Phyllis Kupferstein said in a statement to CNN, "We have said from the beginning that this claim was unjustified, and we are pleased that the court saw it as we did". Dozens of women have accused Weinstein of rape and sexual misconduct that allegedly took place over decades.

Weinstein is to stand trial in May in NY on five charges - these include rape involving two other women.

In response to the claims, Mr. Weinstein released a few different statements via his lawyers and spokespersons in which he claimed all allegations were false and the relationships were consensual. In October of 2017-just before the resurgence of the viral #MeToo movement-she recounted the accusations again, this time naming Harvey Weinstein as that mogul.
