The brother of Australian cricketer Usman Khawaja has been arrested by counter-terrorism investigators over an alleged faked terrorism plot.

Arsalan Khawaja, 39, faces charges of forgery and attempting to pervert justice over a notebook obtained by police which is alleged to have contained fabricated plans to carry out terrorist attacks in Australia.

The alarming find led to the highly publicised wrongful arrest of Mohamed Nizamdeen, a PhD student and casual employee at the Sydney University campus.

Later, hand-writing experts found differences between the script in the notebook and Mr Nizamdeen's own writing.

Khawaja, whose brother Usman is an opening batsman for Australia's cricket team, was bailed on condition he surrender his passport and report to police three times a week.

"What we will be alleging is that he (Nizamdeen) was set up in a planned and calculated manner. But, really, the person who is responsible for what occurred to him is the person we're alleging manufactured this document", Assistant Police Commissioner Mick Willing told reporters in Sydney.

Usman Khawaja, who is preparing with the Australia squad in Adelaide ahead of Thursday's first test against India, made a brief statement asking for privacy while the case ran its course.

"Out of respect for the process, it would be inappropriate for me to make any further comment".

The New South Wales police have expressed "regret" for Nizamdeen's experience.

According to the Herald, Mr Nizamdeen is now suing police over his arrest, claiming the authorities were "immature" and "unprofessional" in the way they treated him.

Willing said police believe Khawaja orchestrated the set-up and may have been motivated by a dispute over a woman. "I just ask for you to please respect my privacy and my family's privacy during this time", he said.

"He has been charged with one count of attempting to pervert justice [Criminal Crimes act 1914 - Cth] and one count of forgery - making a false document [NSW Crimes Act]".

"In relation to the charging and the subsequent dropping of the charge against the Sri Lankan citizen, we have offered, and have paid his court costs", Willing said.
