USA senators take sides on Trump's Supreme Court pick

Trump I didn't ask Kavanaugh about his views on abortion Group Working To Short-Circuit Trump’s Pick For Supreme Court

US President Donald Trump has named conservative federal appeals court Judge Brett Kavanaugh as his nominee to serve on the US Supreme Court. The full Senate must approve Kavanaugh's nomination before he can replace Justice Anthony Kennedy, who announced his retirement at the end of June.

But those lawmakers seen as possible candidates for defection - namely Sens.

KING: I'm wondering if I can finish up with a personal question. "I think we should have the hearings; let's lay out the facts".

Republicans have little margin of error for the final vote unless a few Democrats can be brought onboard. "And if you care about as much as I do, then you should oppose this nominee".

The two groups are also planning a bus tour in mid-September to support Kavanaugh in all of the states, with the exception of Montana. But in a sign of unity with Trump, he accepted an invitation to Trump's Monday announcement of Kavanaugh.

Opposition figures wasted no time in assailing Kavanaugh, warning his confirmation would usher in the erosion of civil liberties and long-held rights, while conservatives were quick to drum up support for the nominee. They already have also been hammering the message that he would vote to undermine key progressive priorities like the landmark Roe v. Wade decision on abortion rights and the Supreme Court decision affirming the constitutionality of the Affordable Care Act.

Asked Tuesday if that means he wants assurance from Kavanaugh on the issue in order to vote for him, Manchin said he wants to do a deep dive looking at his rulings and findings.

Collins also appears to have staked out a slightly stronger position on Roe v. Wade than Murkowski: "From my perspective, Roe v. Wade is an important precedent, and it is settled law", she told reporters last week. "I will be diligent in measuring the record and in undertaking an independent review". I found them qualified to sit on the court.

The suggestion here is that Kavanaugh therefore believes in an imperial presidency that will be immune to the findings of the never-ending Russian Federation probe headed up by special counsel Robert Mueller.

Well, now we have a maybe-answer to the question of "who will take the seat" in the form of Brett Kavanaugh.

Richard Primus, the Theodore J. St. Antoine Collegiate Professor of Law at the University of MI, said absent an unexpected change in the composition of the Senate or a scandal, it's likely Kavanaugh will be confirmed despite any Democratic opposition.

"Most of the court's business cases are not 5-4", said Ilya Shapiro, a senior fellow in constitutional studies at the libertarian Cato Institute, referring to the narrow votes that often emerge in contentious cases. Just one flipped G.O.P. vote could sink Kavanaugh's chances.

Two senators weighing presidential runs, California Sen. John Thune of South Dakota, the Senate's third-ranking Republican, says.

"As I have said, party of my job as senator includes thoroughly considering judicial nominations, including to the Supreme Court", Donnelly said in a statement Monday night. "A bunch of geezers who are so ready to die they don't give a shit what happens to us".

The G.O.P. could be buffered by defections from the other side of the aisle.

At the same time, Republicans are urging a half dozen Democratic senators, largely those who are up for re-election in Trump-won states, to back the president's choice.

In a press release, the White House said: "Judge Kavanaugh has earned a reputation as a brilliant jurist with impeccable legal credentials, and he is universally respected for his intellect, as well as his ability to persuade and build consensus". This decision will directly impact nearly 40 percent of my state, so I'm very interested in his position on protecting West Virginians with pre-existing conditions.

"The implication is that millions of people are going to have their lives ruined or lose their lives because of this".

The court majority agreed with EPA that it did not have to consider costs in protecting health and safety.
