New Zealand Court Rejects Kim Dotcom US Extradition Appeal

New Zealand's Court of Appeal on Thursday dismissed an anti-extradition claim placed by internet mogul Kim Dotcom, and upheld an earlier verdict that stated the 44-year-old could be deported to the US.

"As people will know, I am prepared to fight to get justice, whether it is for me or others".

He said the court's interpretation of the relevant copyright provisions can not be right, and the precedent set has ramifications in New Zealand outside his case. "My case will be one of those".

If extradited to the United States, the internet entrepreneur would face charges of racketeering and copyright infringement over his now defunct file-sharing platform Megaupload.

Dotcom's lawyer Ira Rothken told Reuters via email that his client would appeal the decision in the country's highest judiciary body, the Supreme Court.

In October a year ago, the United States Supreme Court rejected Dotcom's challenge to the USA government's bid to seize assets held by him and others involved in Megaupload. If handed over to the USA, he and his three co-defendants will face charges of copyright infringement and fraud that resulted in damages to record and film studios to the tune of over $500 million.

In addition to Dotcom, who founded Megaupload and was its biggest shareholder, the U.S.is also seeking to extradite former Megaupload officers Mathias Ortmann, Bram van der Kolk and Finn Batato.

The final decision as to whether the four men will be extradited will be made by Justice Minister Andrew Little.

"The appellants are accused of conduct that, if proved, would establish extradition offences in New Zealand law", it said.

The group lost their case in the North Shore District Court in 2015 and has now lost appeals to the High Court and the Court of Appeal.

He tweeted yesterday that he had spent 165 days in court - and $40 million in legal fees. He changed his last name to Dotcom in 2012.

Discovery in the case has centred on raw communications of the GCSB regarding Mr Dotcom.
