"Please ICE, do the right thing with my husband", his wife Sandra Chica said earlier this week, CBS New York reports.

"Sandra spoke to me as a mother of their two daughters - anxious for her husband and her children", he said in a statement. "As a father of three, I can't imagine the fear she and Pablo are feeling now", Cuomo tweeted.

Pablo Villavicencio was taken into custody on June 1, 2018, at Fort Hamilton Army Base in Brooklyn and now faces deportation.

He went from delivering pizza to being detained by immigration officers.

"Although we are disappointed that Pablo will remain detained, today's stay is a victory for him and his family, and also for due process and the fair administration of justice", one of his lawyers, Gregory Copeland of the Legal Aid Society's Immigration Law Unit said, according to the group's Twitter account.

Villavicencio, an undocumented immigrant from Ecuador, was detained June 1 at the Fort Hamilton base in Brooklyn while delivering an order from the brick-oven pizza restaurant in Queens where he worked.

Villavicencio showed a New York City identification card, also known as IDNYC, as he had done during previous deliveries.

"As a result of military police action at the Fort Hamilton Army Base, in accordance with the Department of Army Access Control standards for all visitors, an individual with a warrant was identified upon seeking entrance to the Fort", said Golden, a member of the Senate Committee on Veterans, Homeland Security and Military Affairs.

Cuomo offered Villavicencio free legal representation and services through the Liberty Defence Project, a state-led project to assist immigrants. He got married to Sandra Chica, a USA citizen, eight years ago and had filed an application for citizenship.

"Every time he called, he's just crying asking me about them", his wife said.

Villavicencio, the father of two little girls who were born in the United States, came to the USA a decade ago.

Yong Yow, the ICE spokeswoman, said that in March 2010 Villavicencio was granted voluntary departure by an immigration judge but failed to depart by July, as ordered.

Villavicencio, 35, lives with his wife and two young daughters on Long Island. The voluntary departure order then "became a final order of removal", she said.

But if he was deported he would have to take the much more hard route of applying from his birth country.

"What prompted them to call ICE?" she asked. "They don't care about the impact this will have on us". Steven Choi, executive director of the New York Immigration Coalition, said in a press release "it's absolutely disgusting when the strongest military in the world punches down by going after pizza delivery men". Cuomo said Villavicencio is a taxpayer who has lived in NY for more than 10 years.
