AG Paxton Praises 5th Circuit Ruling To Uphold Texas' Sanctuary Cities Law

A Texas immigration crackdown on "sanctuary cities" took effect Tuesday after a federal appeals court upheld a divisive law backed by the Trump administration that threatens elected officials with jail time and allows police officers to ask people during routine stops whether they're in the USA illegally.

The 3-0 decision by a panel of the 5th U.S. Circuit Court of Appeals marks a major victory for President Trump, who has demanded punishment for sanctuary cities that thwart the federal government to protect illegal immigrants.

The one part of SB 4 that is still on hold is a provision that punishes local officials from "adopting, enforcing or endorsing" policies that specifically prohibit or limit enforcement of immigration laws.

As passed, Senate Bill 4 allows local law enforcement officers to question the immigration status of people they detain or arrest and punishes local government department heads and elected officials who don't cooperate with federal immigration "detainers" - requests by agents to turn over immigrants subject to possible deportation - in the form of jail time and penalties that exceed $25,000. "The discriminatory impact of the law has already had repercussions across the state, casting a chilling effect throughout Texas' Latino communities".

The Attorney General's office is the key enforcement agency for SB 4 and is accepting complaints regarding entities that violate the law.

Texas Attorney General Ken Paxton also released a statement, applauding the decision and saying "dangerous criminals shouldn't be allowed back into our communities" to potentially commit more crimes. Sessions admonished California politicians for not cooperating with federal authorities on immigration enforcement issues. "Risky criminals shouldn't be allowed back into our communities to possibly commit more crimes".

Mayor Steve Adler was reserved in his statement to the press. "So we need to respond and act, within the law, to preserve as much of that trust as possible".

"Words just can't express how disappointed I am with this ruling". The first step in an appeal would most likely be to request a review by the full Fifth Circuit court.

From here, all parties will await a final ruling from the federal court in San Antonio, with an expectation that this case will ultimately be heard by the Supreme Court.
