"Joseph Percoco was found guilty of taking over $300,000 in cash bribes by selling something priceless that was not his to sell, the sacred obligation to honestly and faithfully serve the citizens of NY", U.S. Attorney Geoffrey Berman said in a statement.
"Your Honor, we have reached a verdict", read a note sent out Tuesday at 11:42 a.m. "Thanks!"
Still, Percoco was convicted of conspiracy to commit honest services fraud, conspiracy to commit honest services wire fraud and solicitation of bribes and gratuities. A second executive with the company, Joseph Gerardi, was acquitted on all counts. The jury said it was deadlocked on charges against Kelly. Neither Percoco nor any of his co-defendants testified on their own behalf.
In a statement, U.S. Attorney Geoffrey S. Berman released a statement saying, "Joseph Percoco was found guilty of taking over $300,000 in cash bribes by selling something priceless that was not his to sell - the sacred obligation to honestly and faithfully serve the citizens of NY".
Defense attorneys argued the entire case rested on unreliable testimony from the government's star witness, Todd Howe.
At one point, the key prosecution witness, a long-time lobbyist and supposed bribe-intermediary named Todd Howe, was arrested for credit card fraud, almost blowing up the whole case against Percoco.
At trial, Howe's testimony focused on the two different schemes for his clients to help Percoco get money - or "ziti", as the two called it in emails - to help with his finances, while Howe was able to ensure continuing retainers from his clients by using Percoco to get things done in Albany. Mr. Aiello and Mr. Gerardi also face charges in that trial.
The first notice came last Tuesday, the same day three jurors cited work and child care issues in asking to be dismissed.
The trial was originally set to take four to six weeks but has dragged into its eighth week.
One guilty verdict involved a scheme in which an energy company with state regulatory decisions ahead of it arranged for a "low-show" job for Percoco's wife.
Percoco was indicted on bribery and conspiracy charges in November 2016.
The prosecution also showed how Percoco continued to use his state office and flex his muscle even after he'd supposedly resigned in 2014 to work on the governor's campaign full-time.
Percoco was then expected to help Kelly, 54, land a financing deal for a controversial Hudson Valley power plant worth some $100 million, prosecutors said.
At the height of his influence, Percoco, whom Cuomo had once described as his father's "third son", was known as the governor's enforcer, responsible for everything from keeping lawmakers in line and intimidating Cuomo's political rivals to making sure chairs and thermostats were in order for the governor'spublic appearances.
