
Former White House chief strategist Steve Bannon is not expected to appear before the House Intelligence Committee Tuesday, risking being held in contempt for failing to comply with a subpoena, according to a source close to the process.
Bannon's lawyer has been negotiating with the committee and the White House about the interview's terms.
Representative Mike Conaway of Texas, the top Republican in the intelligence panel's Russian Federation investigation, said on Monday evening that he was "not aware of any executive privilege" being invoked to allow Bannon to sidestep questions about his conversations with Trump. During that meeting, he frustrated lawmakers on both sides of the aisle by refusing to answer questions pertaining to his time in the White House.
Following their unanimous vote to release a Democratic rebuttal of the GOP FISA memo, several members of the Intelligence Committee expressed little certainty to CBS News that Bannon would be appearing before them.
He is expected to meet with investigators on Mueller's team next week, Reuters reported.
Sources told Fox News at the time that Bannon did not specifically invoke any sort of legal privilege, including executive privilege, to support his refusal to answer questions.
"Our subpoenas have to matter", Republican Rep. Tom Rooney, a member of the House intelligence panel, told reporters.
The source said Bannon would answer all of Mueller's questions when he appears before him, which is expected next week. "And if we have a subpoena out there that's being ignored and we don't do anything about it, guess what: Nobody's going to come down to [the committee] anymore and answer questions".
Asked how the committee would respond if Bannon did not show up on Tuesday, Conaway demurred on a possible contempt finding.
But he reportedly gave very few answers, even after the committee issued him a subpoena on the spot to compel him to talk.
